These Terms & Conditions of Purchase (“Terms”) apply to all purchases from Tuk Tuk Thai LLC (“Tuk Tuk Thai,” “we,” “us,” or “our”) through our website, phone, third-party platforms, or in person (collectively, the “Services”). By placing an order or purchasing any item, you agree to these Terms and our Refund Policy and Privacy Policy.

If you do not agree, please do not place an order.

1. Ordering & Acceptance

  1. Order Placement. You may place orders through [our website], by phone, in person, or via approved third-party services.
     
  2. Order Acceptance. Your order is accepted only when we confirm it (e.g., on-screen confirmation, email/text confirmation, or verbal confirmation).
     
  3. Right to Refuse/Cancel. We may refuse or cancel orders for reasons including suspected fraud, item unavailability, pricing errors, or operational constraints. If we cancel an accepted order, we will refund any amount paid.
     

2. Pricing, Taxes & Fees

  1. Pricing. Menu prices are listed in U.S. dollars and may change at any time without notice.
     
  2. Taxes/Fees. Applicable sales tax and service/delivery fees are added at checkout or purchase.
     
  3. Third-Party Pricing. Prices on third-party delivery apps may differ from in-store/website pricing due to platform fees and agreements.
     

3. Payment

  2. Authorization. By providing payment information, you authorize us (and our payment processors) to charge the total amount, including taxes and fees.

4. Food Preparation, Substitutions & Availability

  1. Made-to-Order. Our items are prepared fresh. Minor variations in appearance, portioning, or spice level may occur.
     
  2. Availability. We may run out of ingredients or menu items. If so, we may contact you to substitute or remove an item.
     
  3. Substitutions. Unless you decline substitutions at checkout, you authorize reasonable substitutions of equal or greater value when needed.
     

5. Allergy & Dietary Disclaimer

  1. Cross-Contact Risk. Our kitchen handles common allergens (including but not limited to peanuts, tree nuts, shellfish, fish, wheat, soy, eggs, dairy, sesame). Cross-contact may occur.
     
  2. Customer Responsibility. You are responsible for reviewing ingredients and informing us of allergies or dietary restrictions when ordering.
     
  3. No Guarantee. We cannot guarantee any item is completely allergen-free. By ordering, you accept this risk.
     

6. Pickup, Delivery & Timing

  1. Estimated Times. Pickup/delivery times are estimates and may vary due to volume, traffic, weather, or other factors.
     
  2. Pickup Responsibility. For takeout, you are responsible for picking up at the selected time. Orders not picked up promptly may decline in quality and are not refundable for lateness.
     
  3. Delivery Address Accuracy. You are responsible for providing accurate delivery details (address, unit, gate code, phone). We are not responsible for issues caused by incorrect information.
     
  4. Risk Transfer.
     
    • Pickup: Risk transfers to you at the time you pick up the order.
       
    • Direct Delivery: Risk transfers upon delivery to your address or designated drop-off point.
       

7. Cancellations & Refunds

  1. Food Orders. Because prep may begin immediately, cancellations are limited. See our Refund Policy for details.
     
  2. Catering/Large Orders. Catering may require deposits and specific cancellation windows. See our Refund Policy.
     
  3. Third-Party Orders. Refunds for orders placed through third-party apps must be requested through that platform, which sets its own rules.
     
  4. Policy Integration. The Refund Policy is incorporated into these Terms by reference. Cancellation/refund terms should be clearly disclosed and consistently followed.
     

8. Gift Cards

  1. Final Sale. Gift cards are non-refundable and not redeemable for cash except where required by law.
     
  2. Expiration/Fees. Gift card expiration and fees (if any) follow federal/state law and will be disclosed on the card or at purchase. Laws vary by state; some impose limits on expiration and require cash-out for small balances.
     
  3. Lost/Stolen. Treat gift cards like cash. We are not responsible for lost or stolen cards without proof of purchase and remaining balance verification.
     

9. Promotions & Discounts

  1. Terms Apply. Promotions, coupons, and discounts are subject to stated terms, may be limited in time/quantity, and cannot be combined unless expressly allowed.
     
  2. Modification/Withdrawal. We may modify or end promotions at any time.
     

10. Customer Conduct

You agree not to:

  • provide false information,
     
  • attempt chargeback fraud,
     
  • abuse staff,
     
  • disrupt operations, or
     
  • use our Services unlawfully.
     

We may refuse service or ban accounts for violations.

11. Intellectual Property

All website content, logos, menus, photos, and branding are owned by Tuk Tuk Thai LLC or licensors. You may not use or copy them without written permission.

12. Limitation of Liability

To the fullest extent allowed by law:

  1. Tuk Tuk Thai LLC is not liable for indirect, incidental, special, or consequential damages arising from your purchase or use of the Services.
     
  2. Our total liability for any claim is limited to the amount you paid for the specific order giving rise to the claim.
     
  3. Nothing in these Terms limits liability that cannot be limited under applicable law.
     

13. Indemnification

You agree to indemnify and hold harmless Tuk Tuk Thai LLC, its owners, employees, and agents from claims arising out of your breach of these Terms, misuse of Services, or violation of law.

14. Dispute Resolution & Governing Law
